Could private contractors hold UAP records?

The possibility is not speculative. Modern US national security programmes routinely rely on contractors for research, engineering, testing, data analysis, manufacturing, and classified support work. As a result, records connected to government activity can sometimes be generated or stored by companies rather than by federal employees.

The enacted UAP records provisions recognise this reality indirectly. Which private records the final law may cover

The enacted law is narrower than many public discussions suggest, but it is not limited to records physically stored inside government offices.
